German Parliament Passes New Federal Data Protection Act

The old BDSG has been recently replaced by the new BDSG, in order to adapt its legal discipline to the upcoming EU GDPR. Changes entail:

  • increases of penalties: up to E20M or 4% of the global revenue, whichever the highest.
  • companies will bear the onus of proof regarding compliance to the law.
  • non-pecuniary damanges can be held into account
